Debt recovery in Israel at a glance

Debt recovery in Israel usually starts with a lawyer's demand letter. If it is ignored, a cheque or bill of any amount, or a liquidated sum of up to NIS 75,000 backed by a document the debtor signed, can be filed directly at the Execution Office (הוצאה לפועל) under the Execution Law, 5727-1967; any other debt needs a court judgment first. Debt collection itself - attachments, examination of the debtor and restrictions - happens at the Execution Office. A debt recovery lawyer in Israel runs the whole path, from the first letter to collection, for creditors in Israel and abroad.

How do you recover a debt in Israel?

Send a demand, then file a court claim or go straight to the Execution Office with a cheque, bill or liquidated sum - Execution Law, 5727-1967, Sections 81A and 81A1. A cheque or bill of any amount, or a liquidated sum of up to NIS 75,000 backed by a document the debtor signed, is filed without a lawsuit; any other debt needs a court judgment first.

  1. Demand letter: the amount, the legal basis and a payment deadline.
  2. Execution Office directly: cheques and bills of any amount, liquidated sums up to NIS 75,000.
  3. Court claim: any other debt, for a judgment with interest and linkage.
  4. Collection: attachments, examination of the debtor and restrictions.

Someone owes you money and will not pay

When someone owes you money in Israel and refuses to pay - whether it is an unpaid personal loan, a bounced cheque, a service that was never paid for, damage to your property, or an agreement that was simply ignored - you have clear legal tools. Israeli civil law gives creditors a structured path: a formal demand letter that puts the debtor on notice, then a court claim or an Execution Office file. Collection follows at the Execution Office, which can attach bank accounts, wages and assets. The key is knowing which route fits your situation, and starting at the right stage.

This page covers money claims by private individuals and by businesses: unpaid loans, dishonoured cheques, unpaid invoices, broken agreements, neighbour damage, unjust enrichment and the enforcement of judgments. Money claims are one part of our civil practice in Israel. When the question is whether a contract was breached or can be cancelled, or a business dispute is heading for trial, see commercial litigation in Israel.

Money Claims We Handle

Civil money claims in Israel cover a wide range of situations. The common thread is simple: someone owes you money and will not pay. These are the matters the firm handles most often.

Unpaid Personal Loans

Money lent to a friend, family member, colleague or business associate that was never repaid. Bank transfers, messages and written agreements are all usable evidence, even when nothing was signed. A court claim can recover the principal, and the court may add interest and linkage under the Adjudication of Interest and Linkage Law, 5721-1961.

Bounced Cheques (שיקים חוזרים)

A cheque is a bill, so it can be filed at the Execution Office without a court judgment (Section 81A of the Execution Law). The debtor then has 30 days to object.

Unpaid Invoices & Commercial Debts

A customer who received goods or services and did not pay. For a liquidated sum of up to NIS 75,000, backed by an order, agreement or invoice the debtor signed, a claim can be filed at the Execution Office; otherwise, a court claim. Companies that need collection on an ongoing basis can use our ongoing legal counsel for companies.

Broken Personal Agreements

An agreement made in writing, by message or orally - and not honoured. Payment arrangements, informal deals, services rendered without payment. These are enforceable civil claims under Israeli law, and the evidence is usually already in your phone or your bank statements.

Neighbour Damage Claims

Water damage from an upstairs neighbour, structural damage during renovation, deliberate or negligent harm to your property. Civil claims cover repair costs, loss of use and associated damage.

Unjust Enrichment Claims

When someone has benefited at your expense without legal right - through a failed transaction, a mistaken transfer or a cancelled service - Section 1 of the Unjust Enrichment Law, 5739-1979 (עשיית עושר ולא במשפט) requires the benefit, as a rule, to be returned. The claim can stand alongside a breach claim or instead of it.

Judgment Enforcement

You already hold an Israeli judgment that was not paid, or a foreign judgment against a debtor in Israel. We open the Execution Office file, or first ask an Israeli court to declare the foreign judgment enforceable, and then collect.

Creditors Abroad

Creditors outside Israel recover debts from debtors in Israel through Israeli courts and the Execution Office. Physical presence in Israel is usually not required.

How It Works

The Debt Recovery Process in Israel - Step by Step

Debt recovery in Israel follows a clear legal path. The right entry point depends on the type of debt, the evidence available and the debtor's behaviour. This is how most matters progress.

1

Free Legal Assessment

We review the debt, the evidence and the debtor's likely position. This decides the most effective route - a demand letter, a court claim or a file opened directly at the Execution Office - and what outcome is realistic.

2

Formal Legal Demand Letter

We put the debt to the debtor in writing, with a short deadline and the next step spelled out. For a liquidated sum, this is also where the prescribed pre-filing notice is sent. Whatever the response, the letter becomes part of the record for court or the Execution Office.

3

Court Claim or Execution Office File

If the demand is ignored, a cheque or a bill of any amount, or a liquidated sum of up to NIS 75,000, goes directly to the Execution Office. Any other debt goes to the court with jurisdiction, under the Civil Procedure Regulations, 5779-2018 (in Hebrew). Which court hears the claim is explained in our guide to Israeli courts in business cases; cost and timing are in the questions below.

4

Judgment and Enforcement

Once there is a judgment, or the debtor has not objected in time, the Execution Office can attach bank accounts, wages, vehicles and property, examine the debtor about the debtor's means and impose restrictions. When a debtor says he has no assets, the Execution Office can look into it.

💡 Acting early keeps the most options open. The limitation period for most money claims is seven years (Section 5 of the Limitation Law, 5718-1958), and an early file gives the collection tools more to work with.

Execution Office · הוצאה לפועל

Collecting through the Execution Office

The Execution Office is where debts in Israel are actually collected. It operates within the Law Enforcement and Collection System Authority, under the Execution Law, 5727-1967 (in Hebrew). Three kinds of files can be opened there, and two of them do not need a judgment first.

A cheque or a bill

A cheque, a promissory note or another bill can be filed for execution directly (Section 81A). The debtor is served a warning and has 30 days to file an objection. An objection is transferred to court, where it is heard in substance as a request for leave to defend; without one, the file moves to collection.

A liquidated sum

A claim for a liquidated sum - an amount that can be calculated exactly from the debtor's written obligation - of up to NIS 75,000 on the day of filing can be opened at the Execution Office (Section 81A1). It needs written evidence signed by the debtor, such as a signed agreement, order or invoice, and a prescribed pre-filing notice sent to the debtor first. Here too the debtor has 30 days from the warning to object, and an objection moves the claim to court.

A judgment

An Israeli judgment that was not paid, or a foreign judgment after an Israeli court has declared it enforceable. The file is opened with the judgment, and collection starts once the debtor has been warned and has not paid.

Once the file is open, the tools are the same. The Execution Office can attach bank accounts, wages, vehicles and real estate, and summon the debtor to be examined about the debtor's means. An attachment can also be placed on money others owe the debtor - a bank, an employer or the debtor's own customers - so that it is paid into the file instead of to the debtor. The Registrar can impose restrictions on a debtor found to have the means to pay but to be evading payment, after the debtor was given the chance to show those means (Section 66A): a ban on leaving Israel, suspension of a driving licence, and restrictions on credit cards and on writing cheques. Where there are grounds to believe the debtor is about to leave Israel without paying or securing the debt, the Registrar may, on the creditor's application, order a stay of exit; except in maintenance cases, this is available only where the debtor's total debts are at least NIS 50,000 (Section 14).

When the debtor is a company that cannot pay, or an individual who cannot pay his debts, the matter may move to insolvency proceedings under the Insolvency and Economic Rehabilitation Law, 5778-2018. We tell you early if that is where a file is heading, because it changes the strategy.

⚠️ In practice: the choice between a court claim and a direct Execution Office file is a strategic one. A direct file is faster when the debt is clear on paper; when we expect the debtor to raise a real defence, a court claim can reach a final judgment with less delay. We decide this with you at the start.

Our Clients

Creditors in Israel and around the world

Here, the debt is collected in Israel - under Israeli law, in the Israeli court or at the Execution Office. Where the creditor sits changes how we work together, not the legal service.

Clients in Israel

Private individuals and businesses whose borrower, customer, tenant or neighbour did not pay. We meet at our Herzliya Pituach office or by video. Before anything is filed we look at what you hold - the cheque, the signed order, the bank transfers - because that decides whether the file opens at the Execution Office or in court.

Clients anywhere in the world

You are abroad; the debtor or its assets are in Israel. We run the file here from the first letter to collection, and update you when something happens on it - a warning served, an objection filed, an attachment in place. We tell you at the start how to sign the power of attorney from where you are.

If you already hold a judgment from a foreign court, an Israeli court can declare it enforceable under the Foreign Judgments Enforcement Law, 5718-1958. Among the conditions in Section 3: the foreign court had jurisdiction, the judgment can no longer be appealed, and it is enforceable where it was given; Section 4 adds reciprocity - the courts of that country enforce Israeli judgments. Under Section 5 the petition is filed within five years of the judgment, unless a treaty sets another period.

Why Choose Us

Why Creditors Choose Eliyahu & Co.

Recovering money through the Israeli legal system takes more than filing a claim. It takes strategy - knowing when to push, when to negotiate, when to go to court and when to use the enforcement tools directly.

From our practice

A client lent a significant sum to a family member without any written agreement. We proved the loan in court through the bank transfers and WhatsApp messages between them, and the court gave judgment in the client's favour for the full amount of the loan.

Every case turns on its own facts. This case does not predict the outcome of another.

Civil Law Is Our Core

Civil money claims and litigation are a central part of the firm's practice.

Documents First

Before any step, we check what you can prove on paper. That decides the route, the cost and how quickly collection can start.

Fees

How Legal Fees Are Structured

A bounced cheque filed at the Execution Office is a different job from a defended claim in court, so the fee follows the work. It is set by the nature of the work and agreed in writing in advance, for each stage separately, so you commit to the next step only when it is needed.

Demand Letter

The first stage, agreed in advance. Fast to prepare, and sometimes enough to resolve the matter without further steps.

Court Proceedings

Agreed before filing, according to the nature of the claim and whether the debtor is expected to defend it.

Execution Office (הוצאה לפועל)

Agreed separately, according to the file and the debtor's known assets. Court and Execution Office fees are separate, and we tell you about them before they arise.

International Clients

All terms confirmed in writing before engagement, with the whole process handled remotely.

FAQ

Frequently Asked Questions

Common questions from creditors in Israel and abroad about recovering money through the Israeli legal system.

A debt recovery lawyer in Israel represents creditors who are owed money - an unpaid loan, a bounced cheque, an unpaid invoice, a broken agreement, property damage or unjust enrichment. The lawyer sends the demand letter, chooses the route (a court claim, or a file opened directly at the Execution Office), and then collects the debt through the Execution Office under the Execution Law.
Usually a demand letter first. If it is ignored, there are two routes. A cheque or bill of any amount, or a claim for a liquidated sum of up to NIS 75,000, can be filed directly at the Execution Office. Any other debt goes to court for a judgment, which is then enforced at the Execution Office. The right route depends on the amount, the documents you hold and the debtor's circumstances.
Yes. A loan between friends, relatives or business contacts is an enforceable debt even with nothing signed. Bank transfers, messages and emails can prove both the loan and the promise to repay. Without a cheque or a signed document for a fixed amount, the claim usually goes to court first, and the judgment is then collected at the Execution Office.
Take the original cheque, as returned by the bank, to the Execution Office. Under Section 81A of the Execution Law, 5727-1967, a cheque is a bill and can be filed for execution without a lawsuit. The debtor has 30 days from the warning to object; an objection sends the dispute to court, and without one the file moves to collection.
Yes. Under Section 81A1 of the Execution Law, a claim for a liquidated sum of up to NIS 75,000, supported by a document the debtor signed, can be filed at the Execution Office after a prescribed pre-filing notice. If the debtor does not object within 30 days of the warning, the Execution Office proceeds to collection. If the debtor objects, the claim is transferred to court. In court, claims of up to NIS 75,000 are generally heard in the expedited procedure of the Civil Procedure Regulations, 5779-2018.
The Execution Office can attach bank accounts, wages, vehicles and other assets, and examine the debtor about the debtor's means. The Registrar can impose restrictions under Section 66A of the Execution Law on a debtor found to have the means to pay but to be evading payment - such as a ban on leaving Israel, suspension of a driving licence and restrictions on credit cards and cheques. Where there are grounds to believe the debtor is about to leave Israel without paying or securing the debt, the Registrar may, on the creditor's application, order a stay of exit; except in maintenance cases, only where the debtor's total debts are at least NIS 50,000 (Section 14).
The general limitation period is seven years from the day the cause of action arose, under Section 5 of the Limitation Law, 5718-1958. A claim on a cheque or bill is subject to the same seven-year period. Even so, acting early keeps more options open.
Yes. When the debtor or its assets are in Israel, the debt is collected in Israel, and we run the whole process here while you stay abroad. All communication is in English, and we tell you at the start how to sign the power of attorney from where you are. Travel to Israel is usually not needed.
Yes, through a petition to an Israeli court under the Foreign Judgments Enforcement Law, 5718-1958. Section 3 requires, among other things, that the foreign court had jurisdiction, that the judgment can no longer be appealed, and that it is enforceable in the country where it was given. Under Section 5 the petition is filed within five years of the judgment, unless a treaty sets another period. Once declared enforceable, the judgment is collected through the Execution Office.
A demand letter from a lawyer sets out the amount owed, the legal basis and a payment deadline, and says what will follow if it is not paid. Many debts are paid or settled at this stage. The letter also builds the record for court or for the Execution Office if the debt is not paid.
The Execution Office is the state body that enforces judgments and certain documents in Israel. It operates within the Law Enforcement and Collection System Authority, under the Execution Law. It enforces court judgments, cheques and bills, and claims for a liquidated sum, and it holds the tools to collect: attachments, examination of the debtor and restrictions.
There are three parts. A court claim carries a court fee, in most money claims 2.5% of the amount claimed (Regulation 6, Courts Regulations (Fees), 5767-2007). An Execution Office file carries its own fees. Our legal fee is set by the nature of the work and agreed in writing in advance, stage by stage - the demand letter first, then a court claim or an Execution Office file only if needed.
A demand letter sets a deadline of days. A cheque, bill or liquidated-sum file at the Execution Office gives the debtor 30 days from the warning to object; without an objection, the file moves to collection. A defended court claim takes longer: Courts Administration data for 2024 puts an ordinary civil case at about 11 months on average in the Magistrates' Court.
The Execution Office can summon the debtor to be examined and require a statement of income and assets. A debtor found able to pay is given a payment order, and a debtor found to have the means but to be evading payment can face restrictions under Section 66A. A debtor the Registrar declares to be of limited means is protected from some steps, which changes the collection strategy.
Yes. The claim is filed in Israel and the file is run here, so a creditor abroad does not need to travel. Collection is against the company's own assets: bank accounts, money its customers owe it, vehicles and equipment. As a rule, shareholders and directors are not liable for the company's debts, unless a court lifts the corporate veil (Section 6, Companies Law, 5759-1999); when the company cannot pay, the route may be insolvency proceedings.
Debtors who expect a claim may move assets, close accounts or leave the country, and evidence becomes harder to find. An early letter, and where justified an early file at the Execution Office, puts pressure on the debtor while there are still assets to collect from.
