Real Estate & Dissolution of Co-Ownership
Buying, selling, due diligence, purchase agreements, dissolution of co-ownership, family property disputes and real estate litigation.
Eliyahu & Co. is an Israeli law firm and notary office in Herzliya Pituach, near Tel Aviv, for English-speaking clients in Israel and abroad. Adv. Reut Eliyahu, an English-speaking Israeli lawyer and notary with 19+ years of legal experience, handles property purchases and sales, succession and probate orders, company and branch registration and court cases in Israel, with client meetings in English, Hebrew or Spanish. Most clients abroad never travel: documents are signed before a local notary or at an Israeli consulate, and meetings are held by phone or Zoom.
Eliyahu & Co. is a law office and notary in Herzliya Pituach, opened in 2011. It handles real estate transactions, dissolution of co-ownership, civil and commercial litigation, inheritance and wills, company law and opinions on foreign law, from the first consultation to closing or judgment.
Most clients need more than a lawyer who drafts documents. They need someone who checks the title, the tax and the other side's documents before anything is signed, negotiates the terms, and takes the matter to court when an agreement is not possible, while explaining each step in English.
You work directly with the attorney, not with staff. Title and document checks come before every signing. Fees are set by the nature of the work and agreed in writing in advance. Whether you are in Israel or abroad, each step is reported to you in writing.
Look for an advocate licensed by the Israel Bar Association who works in English in your type of matter, and who can handle it remotely if you live abroad. Only an advocate licensed in Israel may represent you before Israeli courts and authorities such as the Land Registry (Tabu) and the Companies Registrar, under Sections 20 and 21 of the Chamber of Advocates Law, 5721-1961; a lawyer abroad can advise on the law of their own country, but cannot file or appear in Israel.

How We Work:
Clients abroad, both Israelis and foreign citizens, rarely need to visit the office. Eliyahu & Co. handles their matters in Israel remotely, by Zoom, email and a power of attorney signed before a notary where they live or at an Israeli consulate. Services in English, Hebrew and Spanish.
Managing, selling, registering at the Tabu and dissolving co-ownership of Israeli property, without flying in, through a notarized power of attorney.
Succession and probate orders, Israeli wills, inheritance disputes, and opinions on the law of the country where the deceased lived.
Incorporating an Israeli company, registering a foreign company's branch in Israel, and ongoing counsel for companies working with Israel.
🇺🇸 United States - Los Angeles, New York, Miami
American clients and Israelis in the USA with property, an inheritance, a business or shares in Israel. Letters testamentary or letters of administration issued in New York, California or Florida are not acted on by Israeli banks or the Land Registry, so the estate needs an Israeli succession or probate order, supported by an opinion on the law of the state where the deceased lived. We coordinate with the US executor and CPA, and US tax questions stay with them. US direct line: +1 (310) 735-4210 · English-speaking Israeli attorney for Los Angeles clients. Beyond estates, clients in the US come to us to buy and sell property in Israel, for commercial contracts and money claims in Israeli courts, and to form an Israeli company or register a US company's branch here. We provide opinions on the law of US states in inheritance, property and divorce matters, and calls are scheduled for US morning hours, which are afternoon in Israel.
🇧🇷 Brazil - São Paulo, Rio de Janeiro
We provide legal services in Israel to clients from Brazil, in São Paulo, Rio de Janeiro and elsewhere, remotely and with no need to travel to Israel. The work covers buying and selling property, co-ownership and other real estate disputes, applications for a succession order or for probate of a will, money and commercial claims in Israeli courts, and setting up an Israeli company or registering a Brazilian company's branch in Israel. We also provide opinions on Brazilian law in inheritance and wills, property and divorce matters. Calls in English, Hebrew or Spanish, at hours that suit Brazil.
🇬🇧 United Kingdom - London
An English grant of probate gives the executors power over assets in England, not in Israel. The Israeli application is usually made on the basis of the English will, with an opinion on English law where the deceased was domiciled in England and Wales. British clients also come to us to buy or sell property in Israel, to sign an Israeli power of attorney before a UK notary, or to have documents certified for use in the UK. Meetings are set for UK hours. We also handle money claims and commercial disputes in Israeli courts, form Israeli companies and register branches of UK companies, and provide opinions on English law in inheritance, property and divorce matters.
🇦🇺 Australia - Sydney, Melbourne
Clients from Sydney, Melbourne and the rest of Australia handle their legal matters in Israel with us without coming here. Calls are planned around the time difference, usually Israeli morning hours, which are evening in eastern Australia. We file applications for succession and probate orders, handle property purchases, sales and disputes, bring civil and commercial claims in Israeli courts, and form Israeli companies or register Australian companies here. We provide opinions on Australian law in estates, wills, property and divorce matters.
🇨🇦 Canada - Toronto, Vancouver, Montreal
Israeli succession lawyers for Canadian families: heirs in Toronto, Montreal and Vancouver come to us when a parent leaves an Israeli bank account or apartment. A certificate of appointment from Ontario, a British Columbia grant of probate, or a Quebec notarial will that needs no probate at home still needs an Israeli succession or probate order before anything in Israel is released. Quebec is a civil law jurisdiction and Ontario a common law one, so the foreign law opinion differs between them. We also handle property purchases and sales for Canadian owners, with the documents signed in Canada. Canadian businesses and individuals also retain us for commercial contracts, money claims in Israeli courts and registering a Canadian company in Israel, and we provide opinions on the law of the Canadian provinces in inheritance, property and divorce matters. Calls are planned around Eastern and Pacific time.
🇫🇷 France - Paris
For families and investors from Paris and across France, the office handles the Israeli side of real estate: the purchase or sale of an apartment, registration at the Tabu, and disputes between co-owners, including court actions to end co-ownership. We also apply for succession and probate orders, conduct civil and commercial litigation, recover debts and register companies in Israel. We provide opinions on French law in inheritance and wills, property and divorce matters. Everything is done remotely, with calls in English or Hebrew at times convenient in France.
🇷🇺 Russia & Ukraine
Clients from Russia and Ukraine can manage legal matters in Israel from where they live. We apply for succession and probate orders for estates in Israel, represent buyers, sellers and co-owners of Israeli property, and bring or defend money claims and commercial disputes in Israeli courts. Business clients come to us to form an Israeli company or to register a foreign company in Israel. We provide opinions on Russian and Ukrainian law in inheritance and wills, property and divorce matters. Calls in English or Hebrew, scheduled across the time difference.
🇵🇹 Portugal - Lisbon
Israelis who have moved to Lisbon or elsewhere in Portugal, and Portuguese clients with interests in Israel, use our services remotely: selling, buying or renting out property in Israel, real estate litigation, succession and probate applications, commercial contracts and disputes, and debt recovery in Israeli courts. We also register companies in Israel and provide opinions on Portuguese law in inheritance and wills, property and divorce matters. Calls in English, Hebrew or Spanish, at hours that suit Portugal.
🇦🇷 Argentina - Buenos Aires
Clients from Buenos Aires and across Argentina can work with us in Spanish. We handle property transactions and real estate disputes in Israel, apply for succession and probate orders, conduct civil, commercial and money claims, and form or register companies in Israel, all without the client coming to Israel. We provide opinions on Argentine law in inheritance and wills, property and divorce matters; an Argentine declaratoria de herederos does not replace the Israeli order. Calls are set at hours that suit Argentina.
🌍 Any Country Worldwide
Clients in the Netherlands and Germany usually hold a Dutch verklaring van erfrecht or a German Erbschein, and sometimes a European Certificate of Succession. Israel is not bound by the EU Succession Regulation, so none of these replaces an Israeli order, although they help prove who the heirs are. Estates in South Africa, Australia and other countries raise the same question. Services in English, Hebrew and Spanish, and foreign documents need an apostille and a certified Hebrew translation for the Israeli authorities. For clients in any country, we handle property deals and disputes, succession and probate applications, civil and commercial litigation and company registration in Israel remotely, and provide opinions on the law of the client's country in inheritance, property and divorce matters, at hours that suit their time zone.

The law does not require it, but in practice every buyer should have a lawyer of their own, separate from the seller's. Your lawyer checks title at the Land Registry (Tabu), verifies no liens exist, reviews the purchase contract, handles tax filings and ensures safe transfer of funds. After signing, a caveat (warning note) is registered under Section 126 of the Land Law, 5729-1969 to protect you until the transfer is registered. How the transfer is registered at the Tabu →
Dissolution of co-ownership (pirkuk shituf) ends the joint ownership of a property in Israel, by agreement or by court order. Under Section 37(a) of the Land Law, 5729-1969, any co-owner can demand dissolution at any time. If the co-owners do not agree, the court orders a division in kind where possible, and otherwise a sale of the property and division of the proceeds. How long it takes depends mainly on whether the co-owners reach agreement. How dissolution of co-ownership works →
Under Israeli law, foreign law is a fact that must be proven, and if it is not proven, the court presumes it is the same as Israeli law. A foreign legal opinion explains what the law of another country says and how it applies to the case. It is often required in inheritance, divorce and commercial cases where foreign law applies. Yes. Through a notarized power of attorney, you can authorize Eliyahu & Co. to act on your behalf for sale, purchase, inheritance, leasing and dealings with Israeli authorities - without traveling to Israel. Meetings are by Zoom, phone or in person.
A foreign company that has a place of business in Israel registers with the Israeli Companies Registrar as a foreign company under Section 346 of the Companies Law, 5759-1999. This requires apostilled corporate documents with Hebrew translations, a local address and a person authorized to accept documents in Israel. The alternative is an Israeli subsidiary, which is incorporated as a new Israeli company. How foreign company registration works →
An Israeli notary authenticates signatures, certifies copies and translations, and issues notarial certificates for use abroad. An apostille is a certificate under the 1961 Hague Convention that confirms the signature, the signer's capacity and the seal on a public document, such as an Israeli notarial certificate, so that other member countries accept it without further legalization. Notarial services are given in English and Hebrew. Notary & Apostille services →
The Registrar of Inheritance Affairs aims to issue a succession order within about 40 days of a complete application, including the publication period, and a probate order within about 40 days of receiving the original will; files referred to the Attorney General's representative take about 50 days (Ministry of Justice service standard, 2026). Files take longer when documents are missing or when the deceased lived abroad and foreign law must be proven. The orders are given under Section 66 of the Succession Law, 5725-1965. Learn more about inheritance in Israel →
A foreign resident sells Israeli shares like any shareholder; heirs first need an Israeli succession or probate order. In a private company, the transfer is recorded in the register of shareholders and reported to the Companies Registrar, and the tax on the sale is reported to the Israel Tax Authority; shares traded on the Tel Aviv Stock Exchange are sold through the bank or broker, which handles the tax withholding. We handle the Israeli legal side remotely. Selling Israeli shares guide →
Generally not on the inheritance itself: under US rules, property received by inheritance is not income to the heir, although income it earns after the date of death, such as rent or interest, is taxable. A US person who receives more than $100,000 from a foreign estate must report it on IRS Form 3520. Israel has no inheritance tax, and there is no US-Israel estate tax treaty. Selling the asset later can raise Israeli tax and US capital gains tax, so we handle the Israeli side and coordinate with your US CPA.
Yes, in most cases. The price can be agreed in US dollars or shekels, and funds are transferred through Israeli banks. The purchase is reported to the Israel Tax Authority and the tax is calculated before signing. We handle the whole process remotely, from the contract to title registration. Full guide for foreign buyers →
In most cases, yes. A buyer abroad usually signs a notarized power of attorney, and a foreign company provides apostilled corporate documents. Most land in Israel is managed by the Israel Land Authority, and under Section 2A of the Israel Lands Law, 5720-1960, a transfer of rights in it to a "foreigner" (broadly, a buyer who is not an Israeli citizen or resident and is not eligible under the Law of Return, or a company such persons control) needs approval, so this is checked before signing. The application is filed with the Registrar of Inheritance Affairs in Israel, and you do not need to come to Israel. You sign the documents before a notary where you live or at an Israeli consulate, and if the deceased lived abroad, the law of that country is proven by an opinion. A US or Canadian grant of probate or letters testamentary does not replace the Israeli order. Succession orders in Israel →
Usually yes, if anything must be filed or argued in Israel. Only an advocate licensed in Israel may represent others for a fee before Israeli courts and authorities such as the Land Registry and the Companies Registrar, under Sections 20 and 21 of the Chamber of Advocates Law, 5721-1961. Estate assets in Israel pass to the heirs only under an Israeli succession or probate order, so heirs abroad usually need an Israeli lawyer as well. Your lawyer at home still advises on the law of your own country. Succession orders for heirs abroad →
The whole process can be done remotely. After a first call or Zoom meeting, you sign a fee agreement and a power of attorney before a notary where you live, with an apostille, or at an Israeli consulate. The lawyer then files in Israel on your behalf and reports on each step. Originals are couriered only when an authority requires them.

Israel has no fixed tariff for most legal work. At Eliyahu & Co., legal fees are set by the nature of the work and agreed in writing in advance, before any power of attorney is signed, and the first consultation, by phone, Zoom or at the office, is free.
